Background

Kathy Milani is a partner in our Calgary office. Ms. Milani was admitted to the Alberta Bar in 1983. She graduated from the University of Saskatchewan Law School in 1982. Ms. Milani became a Partner at Borden Ladner Gervais LLP in 1990.

Professional Experience

  • Examples of transactions handled include conveyance of real estate from a seller's and buyer's perspective, loan transactions where the main security is real estate, leasing of real estate, conveyancing and mortgaging of leasehold real estate interests and transactions involving condominiums.
  • Since 1988, Ms. Milani has handled the conveyance of various multi-unit residential rental projects and related loan transactions involving local and foreign investors. These transactions have involved projects of up to 200 separately titled units and projects valued up to approximately $10 million. She has developed effective systems to provide high quality legal services on a timely basis and in a cost efficient manner for such types of transactions. The documentation on these transactions has included agreements for management, vendor financing, wrap around mortgages, rental guarantees and rental pooling arrangements.
  • She also represents several commercial, residential and condominium land developers. Ms. Milani has assisted in many varieties of condominium developments including bareland as well as high rise development as redivision. She has also organized homeowner associations in connection with regular residential land development and bareland condominium development.

Professional and Community Activities

  • Ms. Milani has been a member at large on the executive committee of the real estate subsection (Calgary) of the Canadian Bar Association and has been involved in subcommittee matters such as responding to the Alberta government's plain language contract initiatives in the residential real estate area. She has been a panel member on various educational courses for lawyers and students-at-law sponsored by the Legal Education Society of Alberta and the Canadian Bar Association (Alberta Branch). She is on the editorial board for the Real Estate Conveyancing guide published by the Legal Education Society of Alberta.
  • From 1991 to 1998, Kathy was the solicitor (appointed on an honorarium basis) for the Mortgage Loans Association of Alberta which is an association of most of the commercial and residential mortgage lenders in the province and others who have a professional involvement in mortgage lending. Her duties included providing periodic reports to the members on new laws and judgements which had an affect on mortgage lenders as well as providing input on proposed legislation which may have affected mortgage lenders.
