The telecommunications regulatory agency OSIPTEL (Organismo Supervisor de la Inversión Privada en Telecomunicaciones) has modified certain articles of one of its resolutions enacted in 2000, which establishes the termination charge applicable to mobile, trunking and personal communications system (PCS) telephony service networks.
The resolution forms part of a set of actions designed to complement the regulatory framework, promote competition and establish the necessary conditions for reducing charges to users. The resolution should have been in effect from January 2001, but its effective date was deferred until March 1 2001 while the involved companies' proposals were studied.
The resolution states that for long-distance and local calls originating in the fixed telephony network and made through public telephones, the maximum average connection charge applicable to mobile, trunking and PCS service networks shall be $0.2053 per minute, calculated per second and not including value added tax.
Therefore, the rule allows operators to establish connection charges for termination of calls in their networks by range and time, provided the average charge does not exceed the established value. In the same way, the charge for local communications originated by fixed service subscribers in the form of mobile, trunking or PCS telephony services shall be fixed by the licensee of the service that originates the call.
OSIPTEL has stated that the level of competition in the local fixed-mobile communications market will be evaluated occasionally to determine whether the charges remain applicable.
