James Oh is a shareholder at the Chicago office of Littler
Mendelson, the largest employment and labour law firm in
the United Sates. He has been defending management in
employment litigation since his graduation from Northwestern
University School of Law in 1987.
Mr Oh’s first-chair trial experience includes obtaining
defence verdicts in trials of an overtime collective action in
Ohio, a disability discrimination case in Georgia, an overtime
claim of a branch manager in Alaska and a pregnancy
discrimination case in Illinois. Other cases for which he has
been lead defence counsel include an overtime action in federal
court in Mississippi which resulted in the only reported decision
that a commercial insurance underwriter is exempt from federal
overtime requirements; a retaliation action filed in Chicago by
the Equal Employment Opportunity Commission which the trial
court twice dismissed and which the appellate court affirmed;
a multi-count discrimination action in federal court in New York
in which summary judgment was granted on all counts;
a collective action in federal court in Arkansas resulting
in a finding that claims adjusters were exempt administrative
employees; and a declaratory judgment action against the
State of California which resulted in a consent decree
recognising that California wage and hour law was pre-empted
by the Employee Retirement Income Security Act.
Mr Oh has also defended multiple wage and hour class
and collective actions under both federal and state law,
prosecuted and defended unfair competition claims and
defended whistleblowing claims. He also counsels clients on
compliance with wage and hour, anti-discrimination and leave
laws, restrictive covenants and affirmative action obligations.
