Dual qualified as a German attorney and a solicitor in England
and Wales, as well as being a member of the Chartered Institute
of Arbitrators, Mathias Wittinghofer routinely handles a full
range of banking and finance-related disputes and international
arbitrations – most notably post-M&A disputes. His clients
include banks, private equity funds and other members of
the banking and finance industry, as well as other major
corporations. He advises on all kinds of contentious issues
in relation to banking and capital markets, including disputes
arising out of derivatives and over-the-counter trading, loan
facility agreements, securitisations, syndicated loans, project
financing and misselling claims.
Dr Wittinghofer’s recent work has included representing a
German bank in a dispute with a municipal company regarding
a high-value collateralised debt obligation portfolio swap
transaction; acting for a special purpose vehicle in a litigation
before the German courts, including the German Supreme
Court, about the validity of a securitisation; advising a German
bank in a dispute with another bank over a
79 million swap
transaction before the English courts; advising a US investment
bank in its capacity as security trustee in a syndicated loan
transaction in a dispute with mezzanine lenders; representing
the arranger bank in a securitisation transaction in its additional
capacity as swap counterparty and liquidity bank in dispute
with the originator; and representing a Cayman Islands private
equity fund in action against non-performing German borrowers.
Dr Wittinghofer has published several articles on banking
and finance law and international arbitration; he regularly
speaks on both topics. He is a lecturer on international
arbitration at the Goethe University in Frankfurt.
