Commission Issues Interim Measures in Milk Case

On June 20 2007 the Cyprus Commission for the Protection of Competition issued directions on interim measures pursuant to an application by Christis Dairies and Charalambides Dairies, two local milk and dairy product producers.

The directions were issued following a complaint filed by the applicants against the Cattle Breeders' Organization, which controls 75% of the fresh milk produced in Cyprus, for (i) abusing its dominant position in the fresh milk market, and (ii) carrying out certain concerted practices in conjunction with two of the applicants' competitors. The complaint arose after the organzation failed to conclude a renewal agreement with Christis for its supply of fresh milk; instead, the organization allocated Christis's former milk quotas to its two main competitors.

The commission's directions compel the organization to supply the applicants with a specific quantity of fresh milk for their production needs pending final determination of the complaint.
