The Civil Aviation Authority (ANAC) recently published Provision 241/2014 on the procedures and requirements for the approval of special or non-scheduled flights in the Official Gazette, modifying Section 18, Annex I of Resolution 764/2010.

Annex I sets out the procedures that petitioners should follow to obtain approval for special or non-scheduled flights when Resolution 764/2010 cannot be complied with due to emergency.

In such cases, the carrier must inform the director of ANAC via email – as well as other relevant ANAC departments from which approval is required for an approved flight to be altered – of the reasons for which Resolution 764/2010 cannot be complied with.

The following information at a minimum must also be provided to ANAC:

  • the name of the carrier;
  • the date, type and number of the requested flight;
  • the model of aircraft in question and its registration number;
  • the route and itinerary of the flight;
  • the arrival and departure airports;
  • the reason for the request; and
  • relevant documentary evidence relating to the request.

If ANAC considers the petition to be viable, it will be approved by email and the relevant airports will be notified. Approval is conditional on the carrier filing the reasons for the extraordinary petition, along with registration, airworthiness, operator and insurance certificates.
