Significant penalties applicable to airlines which infringe EU Regulation 261/2004 have recently been incorporated into Italian law by Legislative Decree 69/2006, which was published in the Official Gazette on March 6 2006 and came into force on March 7 2006.
The decree introduces fines of between €10,000 and €50,000 which may be imposed on any airline. The fines apply in circumstances where boarding is denied or a flight is cancelled and an airline fails to (i) comply with the procedures set out in Articles 4 and 5 of the regulation, and (ii) provide compensation to the amounts established therein.

The organization empowered to monitor compliance and enforce the penalties is ENAC, the Italian Civil Aviation Authority.
