In April 2016 the Competition Protection Commission issued a statement of objection to Energo Pro Grid AD for abuse of its dominant position in the market of connecting clients' sites (located within Energo Pro's licensed territory) to the electricity distribution grid.
The commission's investigation focused on Energo Pro's refusal to connect Kayko OOD's production site to the electricity distribution grid. According to the commission, Energo Pro's refusal prevented Kayko from conducting its normal business activity. Energo Pro's behaviour has forced Kayko to terminate its business as an industrial client of electricity. However, the termination of Kayko's business activity has harmed consumer interests, because consumers have no access to either the goods or services produced and provided by Kayko.
The commission has qualified Energo Pro's refusal to connect Kayko's site to the distribution electricity grid as abuse of dominant position. However, in a press release about the statement of objecton, the commission did not clarify why Energo Pro's refusal to connect Kayko is considered to be unjustified.
Energo Pro has 30 days to submit to the commission all of its objections, relevant evidence and proposals for commitments and to execute its right to be heard.
