Competition & Antitrust North Macedonia
The Commission for the Protection of Competition recently issued a decision determining that two breweries – Pivara Skopje ad Skopje (from December 17 2012) and Pivarnica Prilep ad Prilep (from November 13 2010) – were engaged in resale price maintenance.
The breweries entered into agreements with independent distributors for the sale and distribution of beer. The agreements contained price-fixing provisions. The distributors were allegedly restricted from independently determining resale prices. The agreements with Pivarnica Prilep also contained non-compete clauses with unlimited duration.
The commission fined Pivara Skopje €5.8 million and Pivarnica Prilep €2.7 million.
