The Competition Authority has been conducting a sector inquiry into the fast-moving consumer goods retail sector for some time now and has recently published its preliminary report on the sector.(1) Although the sector enquiry is ongoing, the authority's preliminary opinions are as follows:

  • Notifiability thresholds for mergers and acquisitions in the fast-moving consumer goods retail sector should be reduced - the sector is dominated by slow-moving or unnoticed transactions that usually fall below the thresholds and may have a cumulative effect on the market in the long run.
  • The sector requires a code of conduct and an ombudsman system.
  • Supply agreements between suppliers and retailers over a certain size should be submitted annually to the authority.
