A recent amendment to the Insurance Law has mandated medical expenses insurers to offer insurance products that cover risks which can cause disabilities in individuals. Such products are required to cover the expenses arising from:

  • medical treatment;
  • rehabilitation programmes;
  • therapy; and
  • additional medical services associated with the disabilities.

These products may be designed as special products or additional benefits.

The amendment decree also revised the General Law for the Inclusion of Disabled Individuals, which prohibits any type of discrimination against individuals with any type of disability. The decree defines various disabilities, including physical, mental, intellectual and sensorial disabilities; these definitions will pose challenges for insurers when designing products that comply with the new mandate.

Insurers must register the new products and benefits that comply with these amendments with the National Insurance and Surety Commission.
