First, the court granted a preliminary injunction on behalf of Air New Zealand Ltd, thereby suspending the registration of the trademark AIR NEW ZEALAND which the Brazilian Patent and Trademark Office had granted to the Brazilian firm GSA Ltd. In accordance with Brazilian procedural law, the plaintiff, Air New Zealand, has been given 30 days to file an action against GSA to prohibit GSA from registering the mark.
The second case concerned the registration of a domain name in Brazil. The US firm America Online obtained an injunction against the Brazilian company WGM Ltd, established in the state of Paraná. WGM applied to register the domain name 'Americanonline.com.br' with the local agency responsible for domain name registrations. America Online has 30 days to file a claim with the court to prohibit the registration by WGM, and WGM has 15 days to appeal the ruling regarding the injunction.
