The Ministry of Industry and Information Technology (MIIT) recently established third-party testing institutions to monitor mobile apps and ordered app operators found to have infringed users' rights and interests to rectify this problem.(1)

The MIIT subsequently found that 16 app operators had failed to meet the rectification requirements and ordered them to comply with its request by 25 May 2020. Failure to comply with the rectification requirements by that date would result in the MIIT issuing additional measures under the corresponding laws and regulations.

According to the MIIT, the 16 app operators had infringed users' rights and interests by:

  • collecting and sharing personal information without the users' permission;
  • collecting personal information beyond the agreed scope;
  • making it difficult to deregister;
  • asking for excessive authorisation;
  • forcing users to use a target-pushing function; and
  • denying access to users if they did not give their authorisation.
