On 31 May 2019 the Cyberspace Administration of China issued the Provisions on the Cyber Protection of Personal Information of Children (Draft for Comment).(1) The public consultation period closed on 30 June 2019.

According to the draft provisions, network operators should:

  • formulate special:
    • rules to protect children's personal information; and
    • user agreements; and
  • employ a personal information protection specialist or designate personnel to oversee the protection of children's personal information.

Network operators should use children's personal information only for the agreed purpose and within the agreed scope. If there is a business need to use the information for other purposes or beyond the agreed scope, such use will be subject to the explicit agreement of the child's parent or guardian.

The draft provisions also require network operators to take protective measures (eg, encryption) to ensure the security of children's personal information.
