The Cyberspace Administration of China recently published the draft Regulations on Network Eco-governance for public consultation. The regulations aim to:

  • strengthen network eco-governance;
  • maintain network order; and
  • protect the legitimate rights and interests of citizens, legal persons and other organisations.(1)

The regulations apply to the actions of network information content producers, network information content service platforms and network information content service users which are prohibited from producing illegal or harmful information.

Further, the regulation imposes specific monitoring and intervention obligations on network information content service platforms, including not transmitting illegal or harmful information and informing the relevant authorities when such information is detected.

When personalised recommendation algorithms are used to promote content to users, network information content service platforms must use models which reflect the mainstream value, take manual intervention measures and establish user self-selection mechanisms.

Network users must also ensure that they do not post illegal and harmful information. Among other things, they cannot use new technologies such as deep learning and virtual reality to engage in illegal activities.
