Akiko Monden is a partner at Atsumi & Sakai. Since starting her
legal career in 2001, she has practised labour and employment
law and international dispute resolution. She specialises in
advising and representing employers in employment law matters.
She has extensive experience in advising domestic and
multinational corporations on various employment law issues,
including restructuring and downsizing, poor performance
management, health and safety in the workplace (eg, mental
health issues such as depression, which has become one of
the most serious workplace problems in Japan), remuneration
(eg, methods to structure payment of overtime allowances,
another major issue under current Japanese employment law),
discrimination, harassment and union activities.
Her expertise also stretches into areas of law which often
become relevant in resolving employment issues, such as
social and labour insurance, immigration, intellectual property,
personal data protection, outsourcing of work such as worker
dispatch (temporary workers), and mergers and acquisition
and other aspects of corporate law, insofar as the treatment
of employees is concerned.
She routinely drafts and reviews documents such as
employment contracts and rules of employment; conducts
investigations of alleged sexual harassment and other
misconduct, and advises on the steps to take based on the
results; and represents employers in employee negotiations
(eg, to seek the voluntary resignation of an employee),
collective bargaining, litigation, mediation and arbitration.
Ms Monden is a native speaker of Japanese and English,
and uses both languages in her legal practice. She also
regularly holds seminars and publishes articles on
employment law topics in both Japanese and English.
In 2011 she has been named as a Leading Lawyer in
management labour and employment by
Who’s Who Legal.
