Founded in November 2001, Bichara, Barata
& Costa Advogados started out with five
lawyers working in a single office in Rio de
Janeiro. A decade later, it has grown to 140
lawyers and 340 people overall. It has offices
in Rio de Janeiro, Sao Paulo, Brasília, Belo
Horizonte, Vitoria and Volta Redonda, and
has established alliances with other respected
firms in Brazil and abroad.
Main areas of practice
Tax law
The firm provides litigation, consultancy and
planning services. The litigation practice has
dealt with thousands of administrative and
judicial cases of varying complexity and
monetary value, covering a wide range of
sectors. A team based in Brasília specialises
in identifying leading cases and researching
judicial opinions on tax matters. The firm
also assists clients in obtaining clearance
certificates - a prerequisite for contracting
with government entities and participating
in public bids.
Civil law
The firm defends its clients’ interests in a
wide range of disputes involving rights and
obligations, consumer relations, contracts,
real estate, family and probate matters and
court-supervised reorganisations. Its lawyers
have experience of litigation at all levels, as
well as arbitration.
The firm assists in the drafting, revision
and termination of commercial contracts and
in general commercial negotiations, including
cross-border transactions. Work includes
purchase and sale agreements, guarantees,
commercial representation, rental and leasing
agreements, distribution and franchising.
As well as advising on how to prevent
consumer complaints, the firm’s consumer
affairs experts represent clients in lawsuits
involving a variety of products and services.
The real estate practice covers consultancy
and litigation, as well as structuring for
purchase and sale transactions, leases and
regularisation of title. The firm undertakes work
in connection with malls and retail properties,
subdivisions, condominium developments,
surface rights, investment funds and consortia.
The firm undertakes judicial and administrative
litigation and preventive consulting on all
aspects of labour relations, including the
evaluation of labour risks in proposed
transactions. It advises on restructuring
human resources departments and minimising
operational costs and litigation risk.
Social security
The firm assists private pension entities and
the public social security system in contentious
and non-contentious work, representing clients
in administrative and judicial matters and
preparing legal opinions. It also undertakes
due diligence, supports private pension plan
structuring and formulates cost-reduction
The environmental law department has
extensive experience of the environmental
aspects of the energy and extractive industries,
chemicals, steelmaking, transportation, real
estate, sanitation and waste, the pulp and
paper industry and forestry management. Its
expertise includes licensing, impact study
analysis, audits and liability evaluation, as
well as environmental aspects of mergers
and acquisitions, financing arrangements
and asset leases.
Corporate, mergers and acquisitions and
capital markets
Advice to national and foreign clients covers
restructurings, mergers and acquisitions,
spin-offs and structuring of transactions.
Work in this sphere includes the incorporation
of, and advice to, limited liability companies,
corporations, investment funds, joint ventures,
associations and foundations. The firm also
assists with due diligence, amendments to
contracts and bylaws, shareholder agreements
and meetings of corporate bodies. The firm
regularly advises shareholders, directors
and officers on financial and capital
markets regulation.
International trade
The firm addresses issues arising from trade
remedy mechanisms, international treaties and
